Complete Systematic Land Program-Public Participation (PTSL-PM) as an Effort to Fulfill Land Ownership Rights Based on the Principle of Legal Certainty
Abstract
The Complete Systematic Land Program-Community Participation (PTSL-PM) is an effort to improve legal certainty and fulfill the land rights of the community. However, the implementation of this program faces complex challenges, especially at the village level. This research aims to analyze the validity of the certificates held by the community through the PTSL-PM program based on the theory of legal certainty, as well as the legal protection against overlapping land certificates in the PTSL-PM program. The research employs a normative juridical method with a legislative approach, specifically using a descriptive analytical approach. Qualitative analysis of secondary data is conducted. The results of this study show that the PTSL-PM program is still not optimal, both in terms of administrative problems, and the implementation of imitation in the field which has an impact on the legal certainty of land ownership rights.
